Virginia Democrats Broke Their Own Rules and Louise Lucas Called It Fairness

Mar 11, 2026

Louise Lucas stood at a podium in February and told Virginia she was going to give Democrats 91% of the state's congressional seats.

Now she's asking the voters who built a fair system to call that progress.

That's the brazenness at the center of Virginia's April 21 redistricting referendum, and Republicans across the state aren't letting it slide quietly.

Counties Fight Back Against a Rigged Ballot

Patrick County – named for the man who said "give me liberty or give me death" – didn't wait for Richmond to fix this.

Local officials there passed a resolution delaying early voting on the redistricting amendment, citing a constitutional requirement that 90 days must pass before early voting can begin on a ballot measure.

Democrats didn't wait 90 days.

The amendment cleared the General Assembly on January 16.

Early voting started March 6 – 49 days later.

Del. Wren Williams, a Patrick County attorney working both the legal and political angles of this fight, told Fox News Digital the whole scheme is fiscal recklessness dressed up as democracy.

"Who would vote against 'restoring fairness'?" he said. "That is where I think they have overstepped and overplayed their hand. When I was a young attorney, an older attorney told me one time, pigs get fat and hogs get slaughtered."

Patrick County isn't alone.

Campbell, Charlotte, Spotsylvania, Prince George, Scott, Washington, Floyd, Roanoke and the city of Lynchburg have all considered or pursued similar resolutions.

The RNC, the NRCC, and Republican Congressmen Ben Cline and Morgan Griffith filed a 48-page lawsuit in Tazewell County Circuit Court calling the entire process an illegal power grab.

Judge Jack Hurley has blocked the referendum twice – ruling the Democrats' process unconstitutionally flawed and their ballot language deliberately misleading.

The phrase "restore fairness" appears on the actual ballot.

In a state where Trump won 46% of the vote in 2024, Democrats want 91% of the congressional seats.

Louise Lucas's Map Would Silence Half of Virginia

The numbers tell you everything about what Virginia Democrats are actually doing here.

Virginia currently sends six Democrats and five Republicans to Congress.

The map Lucas and House Speaker Don Scott unveiled would flip that to 10 Democrats and one Republican – a single seat in the southwest corner of the state.

Rep. Ben Cline's current district – the heart of Virginia's top agricultural region – gets carved into five pieces under the new map, with much of it absorbed into Northern Virginia suburbs that have nothing in common with the farm country Cline represents.

Lucas has made no effort to hide what this is.

"Donald Trump knows he's going to lose the midterms," she told reporters in February. "That's why he started this mess in the first place."

She invoked Trump's name to justify breaking the rules Virginians set in 2020.

RNC Chairman Joe Gruters called it exactly what it is – Democrats trying to "ram through" an illegal redistricting scheme that a Virginia court already labeled a "blatant abuse" of power.

Democrats Proved They Can't Be Trusted With Maps

This isn't Virginia Democrats' first redistricting offense.

After Republicans drew racially gerrymandered maps following the 2010 census, federal courts struck them down and remapped 25 districts – handing Democrats the legislative majority they used to push through a wave of progressive legislation.

Voters responded by approving a bipartisan redistricting commission in 2020 with 66% of the vote.

That commission deadlocked, so the Virginia Supreme Court stepped in and drew maps that a Virginia Tech political scientist called "rather fair" – maps that, even without any redistricting, could produce an 8-3 Democratic majority in a strong Democratic year.

That wasn't enough for Louise Lucas.

She wanted 10-1, and she was willing to break procedural rules, rush an election past a constitutional deadline, use misleading ballot language, and override a supermajority of Virginia voters to get it.

The Virginia Supreme Court has allowed the referendum to proceed while it reviews the legality of the underlying amendment – meaning the court's ruling on the merits will come after Virginians have already voted.

Del. Williams put the Democratic strategy plainly: "If it passes, they're going to say, 'the majority has spoken.'"

That's the plan.

Rush the vote, lock in the result, dare the courts to undo it.

Louise Lucas looked at a 66% supermajority of Virginia voters who built a fair system – and decided her party's midterm math mattered more.

That's who she is.

Republicans across Virginia are voting no on April 21, fighting this in court, and making sure every county that stood up to this power grab gets remembered.

Democrats rigged the rules in Texas and North Carolina and called it politics.

Lucas tried to rig Virginia and called it fairness.

Voters know the difference.
