Scott Turner Just Closed the Clinton Housing Loophole That Let Illegals Jump the Line on American Families

Mar 1, 2026

For decades, American families sat on years-long public housing waitlists while a Clinton-era loophole allowed illegal immigrants to move right in alongside them.

The law was already clear – the Housing Act of 1980 explicitly prohibits HUD from providing financial assistance to ineligible noncitizens.

But that didn't stop Bill Clinton's administration from quietly threading a workaround into the system in 1996, and every administration since turned a blind eye while real Americans waited.

Clinton's "Do Not Contend" Loophole Put Illegal Immigrants Ahead of Americans on the Public Housing Waitlist

The scheme worked like this: rather than proving they belonged there, an illegal immigrant living with a public housing family could sign a piece of paper saying they made no claim about their immigration eligibility — and keep their taxpayer-funded home, no questions asked.

The family accepted lower subsidized rent.

The illegal stayed put.

Real Americans stayed on the waitlist.

HUD Secretary Scott Turner – a former Washington Redskins cornerback who now fights for Americans the same way he fought on the field – just dropped the hammer on it.

Turner's newly proposed rule eliminates the "do not contend" option entirely and requires mandatory citizenship verification for every single person living in HUD-funded housing.

No more honor system.

You prove you belong there, or you don't get a key.

Biden's HUD Paid Dead Tenants and Noncitizens While 200,000 Americans Waited for Verification

Turner's announcement didn't come out of nowhere.

A recent HUD report exposed that Biden-era rental assistance programs had been cutting checks to dead tenants and noncitizens – proof the system wasn't just broken, it was being exploited at an industrial scale.

And a separate audit found that roughly 200,000 current tenants in federally funded housing had incomplete or unknown eligibility verification on file.

Turner called out every administration that looked the other way in a Washington Post op-ed, writing that they had "turned a blind eye" to enforcing HUD's own laws – and that "liberal officials at both the federal and state level purposefully blurred and weakened the law."

That's not bureaucratic failure.

That's a choice.

Trump's HUD Just Freed Up 24,000 Public Housing Spots for Americans

Turner put a number on the problem: roughly 24,000 illegal residents are currently sitting in HUD-subsidized housing across approximately 20,000 mixed-status households.

Think about what that means.

Only about 1 in 4 Americans who qualify for federal rental assistance actually gets it – the waitlists are that long, the competition that fierce.

Every one of those 24,000 units is a spot that an elderly American veteran, a disabled citizen, or a low-income family has been waiting years for.

Turner's rule doesn't punish legal immigrants – green-card holders remain fully eligible, as do refugees, asylees, Cuban emigres, and domestic violence victims with legal status.

"Under President Trump's leadership, the days of illegal aliens, ineligibles, and fraudsters gaming the system and riding the coattails of American taxpayers are over," Turner said.

Kristi Noem backed him up, signing a formal partnership between DHS and HUD to cross-reference immigration data across all 9 million residents currently in public and subsidized housing – closing off the system from inside exploitation as well as new abuse.

"If you are an illegal immigrant, you should leave now," Noem said. "The gravy train is over."

Democrats Built This System for 30 Years – Trump Is Dismantling It in Months

Here's what fires me up most about this story: the law banning this was already on the books in 1980.

Clinton didn't need to create the loophole – he chose to.

Biden didn't need to keep it – he chose to.

And every liberal housing official in between chose to look the other way while American families sat on waiting lists measured in years, not months.

The Heritage Foundation flagged this problem in Project 2025, stating plainly that "HUD's statutory obligations include providing housing for American citizens who are in need" – a statement so obvious it shouldn't need saying, yet it took until 2026 for a HUD secretary to actually act on it.

The left is calling Turner's rule cruel.

What's actually cruel is making a disabled veteran compete for housing against someone who entered this country illegally and then handing that person a loophole big enough to live in.

Trump's team isn't dismantling HUD's mission – they're forcing HUD to fulfill it.
