Pete Hegseth Just Opened a Pentagon Investigation Into Mark Kelly and the Senator Made It Worse

May 14, 2026

Mark Kelly told American enemies exactly what our weapons stockpiles look like after the Iran war.

Now the Pentagon's legal counsel is reviewing whether that conversation on CBS violated his oath – again.

What Kelly said next to dig himself out made everything significantly worse.

The Specific Weapons He Named on National Television

Kelly sat down with CBS's Margaret Brennan on Sunday and spelled it out.

Tomahawks. ATACMS. SM-3 rounds. THAAD interceptors. Patriot rounds.

He said it was "shocking how deep we have gone into these magazines."

He said replenishment will take years.

He said those depleted stockpiles could affect a hypothetical conflict with China.

Every enemy intelligence analyst watching Face the Nation just got a confirmed status report on America's defensive firepower – straight from a senator who sits on both the Armed Services and Intelligence Committees.

Hegseth noticed immediately and fired off a post: "'Captain' Mark Kelly strikes again. Now he's blabbing on TV (falsely & dumbly) about a CLASSIFIED Pentagon briefing he received. Did he violate his oath… again? @DeptofWar legal counsel will review."

Kelly's Defense Made Things Worse

Kelly's response was to post a video clip of a Senate hearing in which Hegseth said replenishment would take "months and years."

"That's not classified, it's a quote from you," Kelly wrote.

The problem with that defense is glaring.

At a public hearing, Hegseth acknowledged broad timelines.

On CBS, Kelly named specific weapons systems and described exactly how deep each stockpile has been hit.

That distinction is precisely what classification exists to protect.

Any foreign intelligence service can speculate that America burned through interceptor missiles defending against Iranian strikes – but speculation without confirmation is useless.

The moment Kelly listed those systems by name and attached specific depletion levels, he converted an adversary's educated guess into confirmed targeting intelligence.

This Is Strike Two in Six Months

This is not the first time Kelly has created a legal crisis over his mouth.

In November, Kelly joined five other Democrat lawmakers in a video urging military service members and intelligence officials to "refuse illegal orders" from the Trump administration.

Trump called it "SEDITIOUS BEHAVIOR, punishable by DEATH!"

Hegseth moved to strip Kelly's Navy Captain retirement rank and cut his pension.

A federal judge blocked that move in February – and the D.C. Circuit Court of Appeals heard arguments just days ago, with a three-judge panel that appeared skeptical of the government's case.

A grand jury also declined to indict.

And now, days after those appellate arguments, Kelly goes on national television and names classified weapons inventory to CBS News.

What the Pentagon Can Actually Do

Kelly's Senate seat gives him some protection.

The speech or debate clause of the Constitution shields members from prosecution for official acts.

But that protection has limits – it covers official legislative conduct, not Sunday morning television appearances.

As a retired Navy captain still drawing a military pension, Kelly remains subject to military justice in ways that a purely civilian senator would not be.

That is exactly why Hegseth keeps invoking Kelly's rank rather than his Senate title.

It is not a rhetorical flourish – it is a legal hook.

The Pentagon has authority to recall a retired officer to active duty and initiate court-martial proceedings, and the review Hegseth just announced is the first formal step in determining whether that authority applies here.

Kelly just handed him a second file.
