Obama-appointed judges spent years telling America they were protecting democracy.
Now two of them just ruled that the elected President of the United States needs a permission slip from Congress to renovate his own house.
Trump read the ruling – and went straight to the Supreme Court.
What the Judges Actually Said
The D.C. Circuit ruled 2-1 that Trump must stop above-ground construction on the $400 million White House ballroom because Congress never signed off on it.
Judge Patricia Millett – Obama appointee – and Judge Bradley Garcia – Biden appointee – wrote that Trump is nothing more than a "temporary tenant" of the White House.
A tenant.
Trump torched that framing immediately on Truth Social, calling the ruling unlawful and politically motivated.
The lone dissenter on the panel was Trump-appointed Judge Neomi Rao, who said the court had "no jurisdiction" over the case and that presidential improvements to the Executive Residence are "likely within the President's authority."
She called the majority's ruling an "abuse of discretion."
She was right.
What Trump Is Actually Building
The two Democrat judges framed this as a fight over a ballroom.
It is not a fight over a ballroom.
Trump laid out exactly what the complex includes: bomb shelters, a state-of-the-art hospital, missile-resistant steel structures, bullet and blast-proof glass, drone-proof ceilings, a rooftop drone port, and top-secret military facilities.
Trump said the Military and Secret Service both view halting construction as a direct national security threat.
The project won unanimous approval from the 12-member National Capital Planning Commission in April.
It is already largely built, already largely paid for, and running ahead of schedule and under budget.

The judges acknowledged the national security concerns – and ruled against the President anyway.
They actually wrote that national security is exactly the reason Congress should be more involved, not less.
That logic would have made FDR laugh out loud.
The Lawsuit Itself Is a Joke
The plaintiff in this case is the National Trust for Historic Preservation.
Think about that.
A preservation group sued to stop the construction of hardened military infrastructure designed to protect every future American president – and two Obama-Biden judges handed them a win.
Trump noted the project demolition began in October 2025 and asked the obvious question: "Why didn't they bring this case long prior to construction starting?"
They waited until the steel was already fabricated and on-site.
The court's own injunction only freezes above-ground construction – the bunkers, medical facilities, and military installations underground can keep moving.
The ballroom – the part Democrats can most easily mock – is what they froze.
What Happens If Two Obama-Biden Judges Win This One
The D.C. Circuit stayed its own ruling for two weeks – they know exactly where this is going.
Six conservative Supreme Court justices are about to read a ruling that calls the President of the United States a "temporary tenant" of his own home.
Think about what that logic actually means if it holds.
Every future president who wants to add a security camera, reinforce a wall, or build a bunker now needs Chuck Schumer's signature first.

Democrat judges just handed a historic preservation nonprofit veto power over White House security upgrades.
The White House has been renovated, expanded, and rebuilt since 1792.
Not once in 234 years did a president go to Congress for permission.
This court just invented that requirement out of thin air – and applied it to bomb shelters and blast-proof glass.
The Supreme Court isn't going to let that stand.
But here's what fires me up: the fact that two judges appointed by Barack Obama and Joe Biden looked at missile-resistant infrastructure protecting the President of the United States and decided a preservation nonprofit's feelings mattered more.
That's not jurisprudence.
That's a political hit dressed up in legal language – and every person in this country who voted for Donald Trump already knows it.
