Jack Smith could be investigated for his witch hunt against Donald Trump

Special Counsel Jack Smith threw in the towel on his two criminal cases against President-elect Donald Trump. 

He dropped his appeal of District Court Judge Aileen Cannon’s ruling that dismissed his classified documents case against Trump because he was unlawfully appointed by Attorney General Merrick Garland. 

A federal judge dismissed the criminal charges against the President-elect over January 6 after Smith asked to have them thrown out because of a Justice Department policy against prosecuting a sitting President. 

Smith’s criminal cases against Trump have come to their conclusion, but his problems could be just getting started. 

Former federal prosecutor Andrew Cherkasky told the Daily Caller News Foundation there was an obligation to investigate Smith’s witch hunt against Trump “because of the huge cost and ultimate failure.”

“Whether that yields findings of criminality is unlikely. However, I think it will find that Smith’s novel legal approach was fraught with issues that should have led a reasonable prosecutor to decline prosecution,” Cherkasky explained. “Smith is already leaving his special counsel post, but I anticipate some of the lawyers working under him will also be forced out of the [Department of Justice] DOJ for engaging in a legally unsound prosecution.”

Smith spent nearly $50 million in taxpayer money on his two criminal cases against Trump. 

“There is a lot of evidence that the congressional Jan. 6 committee intentionally avoided evidence beneficial to Trump’s position, and if Smith did the same, his conduct could be grounds for more severe consequences,” Cherkasky added. 

Conservatives want to bring criminal charges against Trump

The Heritage Oversight Project announced that it was putting together a “model indictment” of Smith. 

Oversight Project Executive Director Mike Howell thought Smith could be charged for depriving Trump of his civil rights under federal law, among other possible charges. 

“Jack Smith and his office must face severe legal, political, and financial consequences for their blatant lawfare and election interference,” Article III Project President Mike Davis wrote on X. “This includes a federal criminal probe for conspiracy against rights under 18 U.S.C. § 241.”

House and Senate Republicans are preparing to open investigations into Smith next year. 

The Special Counsel was asked to preserve his records by House Judiciary Committee chairman Jim Jordan (R-OH) and Representative Barry Loudermilk (R-GA). 

U.S. Senators Ron Johnson (R-WI) and Chuck Grassley (R-IA) sent Smith a letter asking him to save his records as Special Counsel. 

“Due to the apparent political bias of FBI officials that were involved in the genesis of a case against former President Trump, preservation of Special Counsel Smith’s records is more important than ever,” Grassley and Johnson wrote in a letter. “If a politically-charged case is to be opened, it must be done the right way and free from political bias.”

A day of reckoning could be on the way for Jack Smith after leading a witch hunt against Donald Trump.
