The rogue Special Counsel was hoping he would get his big break before the election.

Obama-appointed judge sets trial date for January 6 case

Special Counsel Jack Smith has been rushing to get his criminal case against former President Donald Trump over January 6 moving again.

The case was on hold for most of the year while the Supreme Court considered Trump’s claim of Presidential immunity.

D.C. District Court Judge Tanya Chutkan – who was appointed by former President Barack Obama – set a pretrial schedule that would guarantee there would be no trial before Election Day on November 5.

The last deadline for motions set by Chutkan is on November 7.

“We’re hardly sprinting to a finish line here,” Chutkan said.

She said that because of likely appeals over claims of Presidential immunity in the case, it’s uncertain when it would go to trial.

That decision officially closed the book on Smith being able to put Trump on trial before the Election.

Chutkan claimed that she was thinking about the election with the November 7 deadline for motions.

CNN legal analyst Elie Honig still cried foul on the judge’s claim that politics weren’t involved with the date.

He noted that Chutkan worked hand in hand with Smith during the case to take it to trial as soon as possible.

“It was interesting to hear today — to hear Judge Chutkan say to Donald Trump’s team, ‘We don’t think about the election date at all.’ Now that’s the textbook thing to say, but let’s be real, there’s some hypocrisy here,” Honig explained. “Because in the early days of this case, Judge Chutkan was very much aligned with Jack Smith in a mad rush to get this case tried before the election.”

Judge and Jack Smith wanted Trump on trial before the election

Smith’s January 6 case would normally take years before it went to trial because of its complexity.

Honig called out the effort by Chutkan and the Special Counsel to rush the case to trial.

“The original trial date was seven months after the indictment,” Honig said. “That’s outrageous. You can’t try a case with 13 million documents, seven months after the indictment. No case would normally get to trial that fast.”

He said that Chutkan had the election on her mind with her rushed schedule for the January 6 case.

“So Judge Chutkan and Jack Smith were clearly very much thinking about the trial date, the election date, when they wanted to get the trial in before the election,” Honig stated. “But now that the tables have turned because of the Supreme Court’s decision, all of a sudden from Judge Chutkan it’s, ‘Oh we don’t think about such things.’ I take that with some grain of salt.”

Even CNN’s legal expert can see how political the motivations of the judge and Jack Smith are in the January 6 case.

That case would be shut down for good if Donald Trump wins the election.
