A federal judge in Massachusetts blocked Trump's mail ballot order across 23 states and declared it unconstitutional.
The Supreme Court just told her she was wrong.
And Donald Trump used one legal argument for mail-in ballots that the Democrats never saw coming.
How a Standing Argument Killed Every Democrat Lawsuit in One Shot
Trump signed his "Preserving and Protecting the Integrity of American Elections" executive order back in March.
It did three things Democrats couldn't live with.
First, it directed DHS to build citizenship-verified lists of eligible voters in every state.
Second, it ordered the attorney general to prioritize prosecuting officials who send federal ballots to ineligible voters.
Third – and this one's the big one – it required USPS to mail ballots only to voters on those approved citizenship lists.

Democrat attorneys general in 23 states ran straight to U.S. District Judge Indira Talwani in Massachusetts.
She blocked it.
An appeals court agreed with her.
Then the Justice Department took it to the Supreme Court on a procedural argument: the states jumped the gun – they went to court before federal agencies had even begun drafting the rules to implement the order.
The Supreme Court's six conservative justices agreed – 6 to 3.
Their reasoning was clean and direct: the executive order gives internal directives to federal agencies, not new mandates to states.
"This provision is an internal directive from the President to a subordinate," the Court wrote. "It imposes no obligations on the States, so they suffer no concrete harm from it, and without concrete harm, there is no standing."
Twenty-three lawsuits – gone.
USPS and the Justice Department announced they would begin implementing the restrictions immediately.
Why Democrats Are Calling This a Constitutional Crisis
Justices Sonia Sotomayor, Elena Kagan, and Ketanji Brown Jackson dissented.
Sotomayor complained the conservative majority was being inconsistent – in the past the Court rejected election challenges for coming too late, and now it rejected them for coming too early.
Chuck Schumer called the order an attempt to make it "harder for Americans to vote" and vowed Democrats would "fight every attempt to hijack mail-in voting."
Democrats know exactly what this ruling enables: DHS cross-referencing state voter rolls against citizenship data before the November midterms.

Ballots won't go out to names that don't match.
That's the whole thing – and they spent months in court trying to stop it.
This Is What Happens When You Let Biden's Border Open for Four Years
Here's what the Left will never tell you.
Non-citizens have already been caught voting – not in some hypothetical scenario, but in actual prosecuted cases.
Michigan's own state audit identified 15 non-citizens who cast ballots in the 2024 general election and referred 13 of them to the attorney general for potential prosecution.
One was a Chinese national and University of Michigan student who showed up at an early voting site and voted in person.
If Michigan could find 15 in a single state just by cross-referencing driver's license records against voter rolls, imagine what DHS can find with full federal data behind it.
That's exactly what Trump's order builds – a nationwide citizenship verification system that states running their own elections have never bothered to create.
Texas Attorney General Ken Paxton separately opened investigations into 33 non-citizens for illegally voting in 2024.
The pattern is documented.
The only question was whether Trump had the legal authority to require federal agencies to fix it – and the Supreme Court just said yes.
Democrats calling this an "attack on democracy" are the same people who watched millions of illegal immigrants pour across the border for four years and cheered.
Now Trump wants to make sure none of them are filling out mail-in ballots this November, and suddenly democracy is in danger.
What Comes Next Before November
The Supreme Court was careful to note this ruling only addresses the standing problem – it does not declare Trump's order constitutional on the merits.
That fight is still coming – separate challenges are already in the pipeline.

Judge Talwani also issued a nationwide injunction in a second case, and the Trump administration asked her Monday night to suspend it in light of the Supreme Court's ruling.
The next 60 days are a race against the calendar.
Citizenship lists have to be built.
USPS rulemaking has to be finalized.
States need time to reconcile those lists before the first ballots drop in September.
The window is narrow and the Left knows it.
Every day the order is tied up in court is a day closer to states mailing ballots the old way – no verification, no cross-check, no accountability.
Trump said it plainly on Fox News: "They're going to have to get rid of mail-in voting." The SAVE America Act – his preferred legislative solution – has stalled in the Senate, still short of the 60 votes needed to break the filibuster.
Monday's Supreme Court ruling isn't the endgame.
It's the opening of a door Democrats just spent months nailing shut.
The real fight happens in the next eight weeks – before your ballot goes in the mail.
