Donald Trump Just Kicked Joe Biden Out of the Foster Care System for Good

Jul 17, 2026

Joe Biden used vulnerable children as props for his gender ideology.

Now Donald Trump's HHS just erased the rule that would have forced foster families to affirm a child's "gender identity" – or get quietly filtered out of the system.

And the families Biden spent four years driving out just got their invitation back.

Biden's Rule Would Have Purged Religious Families From Foster Care

The rule Biden finalized in April 2024 wasn't about protecting children.

It was about ideology.

It required state agencies to maintain a supply of "designated placements" – foster homes certified as LGBTQ-affirming, trained in gender identity support, and committed to facilitating "clinically appropriate" gender care for any child who requested it.

Foster families who wouldn't commit to all of it weren't disqualified on paper.

They were just filtered out in practice.

Ken Paxton saw it coming.

Texas sued immediately, arguing the rule would exacerbate the already-critical shortage of foster families and cost the state up to $432 million in federal funding if it refused to comply.

A federal judge in the Eastern District of Texas agreed and vacated the rule before it ever took effect.

Biden's ideological gambit died in court.

But the rule's language stayed on the books in the Code of Federal Regulations – a loaded gun waiting for the next administration that wanted to pull the trigger.

Trump's HHS just removed it entirely.

The Shortage Is Real and Biden Made It Worse

Here's the number that matters.

America has 57 foster homes for every 100 children entering the system.

Not enough. Not close.

When there aren't enough homes, children don't wait in limbo.

According to ACF Assistant Secretary Alex Adams, they end up "in short-term rentals, hotels, government office spaces" – warehoused while bureaucrats argue about ideology.

Adams told The Daily Wire exactly what drives foster family recruitment in America: families with sincerely held religious beliefs and moral convictions.

The data backs him up.

Christians are more than three times as likely to foster as those with no religious affiliation.

Faith-based agencies have been the backbone of American child welfare for over 200 years – recruiting families from churches, providing training, and placing children in stable homes long before the federal government got involved.

Biden's rule sent those families a clear message: your values make you a liability.

"The 2024 designated placement rule was one of those things that we think sent the wrong message," Adams said. "It would have segmented families into those that are 'LGBTQ-friendly' and those that are not."

Melania Trump's Initiative Just Got Its Most Important Building Block

This wasn't just a policy reversal.

It was a message.

Melania Trump's "Fostering the Future" initiative – backed by an executive order signed in November 2025 – has already expanded foster family capacity in 19 states.

The administration's "Home for Every Child" campaign has one goal: a home waiting for every child, not a child waiting for a home.

Faith-based families who walked away – or never stepped forward – now know the federal government won't use their beliefs against them.

Adams explained the strategic logic to The Daily Wire: "The message that we think it sends is that all families are welcome."

All families.

Not the families Washington bureaucrats preapproved.

Not the families who passed Biden's ideological screening test.

All families.

Here's the pattern Democrats don't want you to notice.

Obama started it in 2016 – a $10 million federal grant to build the infrastructure for "affirming" foster placements, quietly seeding the bureaucracy with activists who'd keep the project alive long after he left office.

Biden finished it in 2024 – turning that infrastructure into a federal mandate, with hundreds of millions in funding leverage over every state that refused to comply.

The plan was to make the ideology permanent – baked into federal regulations so deep that no future administration could dig it out without a fight.

Trump just dug it out anyway.

One rule at a time, agency by agency, the Obama-Biden ideological apparatus is getting dismantled.

Foster care was supposed to be untouchable – because who wants to fight about vulnerable children?

Trump fought.

And the 400,000 children waiting for a home are better off for it.
