For decades, Washington told American workers their jobs mattered while writing federal contracts to companies selling Chinese products with American flags on the box.
Now Trump signed the executive order that sends those companies to the Justice Department.
What happens to the companies that lied is something Democrats never let happen before.
The Waiver Racket Nobody Wanted You to Know About
The Buy American Act has been federal law since 1933.
For 93 years, D.C. found ways around it.
The mechanism was the waiver system – a bureaucratic escape hatch that let federal agencies bypass domestic sourcing requirements whenever a foreign product was deemed "reasonably available" or cost more than a small threshold less than the American alternative.
Sounds technical.

Here is what it meant in practice: a federal contractor could source components from China, stamp "Made in USA" on the finished product, and collect your tax dollars while the American factory that used to make those parts sat empty.
Executive Order 14392, signed in March, changes that.
What Trump's Order Actually Does
The order directs federal agencies and the FTC to increase scrutiny of every contractor claiming domestic content.
It requires additional review of suppliers selling products to the government under "Made in America" certifications.
And it empowers agencies to send companies that filed false labeling claims or fraudulent procurement certifications directly to the Justice Department under the False Claims Act.
The False Claims Act is not a regulatory slap on the wrist.
It carries triple damages and per-violation civil penalties – and qui tam provisions allow private citizens to sue on the government's behalf and collect a share of the recovery.

It recovered $2.9 billion in settlements and judgments in fiscal year 2023 alone.
On Sunday, Trump made clear on Truth Social that enforcement is not optional: "I already signed EO 14392 to crack down on fake 'MADE IN AMERICA' claims, and we are enforcing it HARD."
The Pattern Democrats Ignored for 30 Years
This is not a new problem.
The Berry Amendment – which requires the Department of Defense to purchase certain goods exclusively from domestic sources – has been law since 1941.
Pentagon auditors found violations throughout the 2000s and 2010s.
Contractors routinely filed false certifications.
The Government Accountability Office documented repeated failures to enforce existing domestic sourcing requirements across agencies – year after year, administration after administration.
Biden's response was to create a "Made in America Office" that issued guidance documents and held stakeholder meetings.
Biden's Buy American rules increased the domestic content threshold for federal contracts from 55% to 65%.
They did not add criminal referral authority.
They did not close the waiver loophole.

They did not create False Claims Act exposure for fraudulent certifications.
The office Biden created produced 127 pages of reports.
Trump's executive order produces DOJ referrals.
This Is What America First Actually Looks Like
The federal government spent $760 billion on contracts in fiscal year 2024.
That is not a rounding error.
It is the single largest purchasing entity on earth – and for decades it has been used to funnel money to foreign manufacturers while American factories closed and American workers stood in unemployment lines wondering what happened.
Trump is not just changing procurement rules.
He is transforming the federal government from the world's largest customer for foreign goods into the world's largest driver of American manufacturing.

Every agency that issues a waiver now has to justify it.
Every contractor that certifies domestic content now faces criminal exposure if they lied.
Every bureaucrat who rubber-stamped exceptions "like candy" – Trump's words – just became personally accountable for what they approved.
Chuck Schumer held press conferences in front of shuttered factories.
Nancy Pelosi gave floor speeches about workers getting left behind.
Joe Biden called himself a union man his entire career.
Not one of them ever criminalized the fraud that was hollowing it out.
Trump did it in a single executive order.
