Democrats turned the child into a propaganda poster boy with photos of him in his Spiderman backpack surrounded by agents.
Now a Clinton-appointed judge just ordered their release with language so over-the-top that Republicans are calling for his impeachment.
Judge Fred Biery's Immigration Order Used Bible Verses To Attack Trump's ICE
Judge Fred Biery didn't just issue a standard court order Saturday.
He wrote what reads like a political manifesto dressed up as legal opinion.
The order releasing Adrian Conejo Arias and his son Liam from the Dilley detention center in Texas accused the Trump administration of having a "perfidious lust for unbridled power" and showing "ignorance" of the Declaration of Independence.
Biery included a photo of the five-year-old in his bunny hat and Spiderman backpack – the exact image Democrats circulated to generate outrage – and quoted two Bible verses about Jesus and children.
His three-page order accused ICE of showing "perfidious lust for unbridled power" and claimed the Trump administration was "traumatizing children" in pursuit of "daily deportation quotas."
Senator Mike Lee immediately added Biery to his impeachment list.
Republicans Spotted February 31 Date Error In Federal Judge's ICE Order
Beyond the inflammatory political rhetoric masquerading as judicial reasoning, conservatives noticed something else.
At the bottom of Biery's order, he signed it with the date "February 31, 2026."
That date doesn't exist.
In legal documents, technical defects like impossible dates can invalidate entire proceedings or create grounds for appeal.
Conservative analyst Guy Benson called the order "lawless, overwrought resistance slop" – a description the Department of Homeland Security spokeswoman Tricia McLaughlin shared on social media.
DHS's former chief of staff Chad Mizelle wrote he thought the order was fake at first, calling it "the biggest validation of our criticism since Day 1 that the liberal judiciary is unhinged."
The Center for Immigration Studies called the order "bizarre."
Democrats immediately seized on Biery's ruling as vindication, with Rep. Joaquin Castro personally escorting the father and son back to Minnesota and declaring victory on social media.

What Biery's emotional order conveniently omitted was DHS's account of what happened.
According to the Department of Homeland Security, when ICE arrested the father in the driveway, he fled on foot and abandoned his five-year-old son in a running vehicle.
The mother was inside the house.
ICE officers made multiple attempts to get her to come out and take custody of her own child.
They even assured her she would not be arrested.
She refused.
ICE agents had no choice but to keep the boy with his father rather than abandon a five-year-old in a driveway with the car running.
School officials and the mother later claimed ICE used the boy as "bait" to get the mother to open the door – a claim DHS called an "abject lie."
The father and son entered the United States in 2024 using Biden's CBP One app, the controversial tool that made it dramatically easier for migrants to claim asylum and enter the country.
Their lawyer Marc Prokosch insisted they "did everything right" and complained that "ICE didn't care about the fact that they had those pending claims."
That's the kind of thinking that let millions pour across the border under Biden – the idea that claiming asylum magically makes someone immune to immigration enforcement regardless of the merits of their case.
Biery's order requiring their release back to Minnesota ensures this case will drag on for months or years while they remain in the United States.
The judge made clear they might eventually be deported but insisted it should happen "through a more orderly and humane policy than currently in place."
Translation: Trump's enforcement is too effective, so judges need to slow it down.
Federal Judges Are Blocking Trump's Immigration Enforcement In Coordinated Pattern
Biery's theatrics aren't happening in isolation.
In Minnesota, Chief Judge Patrick Schiltz ordered ICE director Todd Lyons to appear in court personally to explain why the agency violated 96 court orders requiring bond hearings for detained immigrants.
Another federal judge in Los Angeles temporarily blocked ICE from making arrests at certain locations before the Supreme Court lifted that injunction 6-3.
Liberal advocacy groups are flooding federal courts with lawsuits challenging every aspect of Trump's immigration crackdown – and activist judges like Biery are happy to oblige with sweeping orders that read more like MSNBC opinion pieces than legal analysis.
The pattern is clear: Democrats can't stop Trump's deportation operations through Congress or the ballot box, so they're using sympathetic judges to throw sand in the gears of enforcement.
Biery's order – complete with Bible verses, founding documents, viral photos, and an impossible signature date – is the perfect example of judicial activism run amok.
