A Federal Judge Slapped Down Kathy Hochul After She Said ICE Agents Were Terrorizing New Yorkers

Aug 6, 2026

Kathy Hochul walked up to an ICE agent and told him he was "terrorizing people" by wearing a mask.

Now a federal judge just told her she had no authority to do anything about it.

The court's ruling made it clear that Hochul never had the authority to begin with.

Courts Are Running Out of Patience With Blue-State Mask Wars

This is not the first time Democrats tried this and lost.

In February, a Clinton-appointed federal judge in California blocked Gavin Newsom's "No Secret Police Act" – a law requiring ICE agents to remove masks during operations.

The judge ruled it unlawfully discriminated against federal officers by exempting California's own state agents while targeting federal ones.

In June, the DOJ sued Virginia Gov. Abigail Spanberger over nearly identical laws – threatening masked federal agents with Class 1 misdemeanor charges.

Associate Attorney General Stanley Woodward was direct: "Governor Spanberger cannot tell federal officers how to do their job."

New York just became the third major state to try this strategy.

The third major state to lose it in court.

U.S. District Judge Mae D'Agostino – an Obama appointee – ruled Monday that New York's mask ban likely violates the Constitution's Supremacy Clause.

The ruling was blunt: "New York cannot impose its own uniform requirements on federal agents simply because it disagrees with how the Federal Government is exercising its authority."

Why Hochul Knew This Was Coming and Pushed It Anyway

Here is what makes this story infuriating.

Hochul didn't stumble into this fight.

She marched into it with cameras rolling.

Back in January, she went on Morning Joe and bragged about walking up to an ICE agent at 26 Federal Plaza and telling him to his face that he was "terrorizing people" by wearing a mask.

She knew about the California ruling.

She watched Virginia get sued by the DOJ. She signed the law anyway – because the goal was never to win in court.

The goal was to make ICE agents' lives harder, expose their identities to the mobs already threatening them, and score political points with the activist left.

One protester was caught on video screaming at an ICE agent – "I HAVE YOUR FACE, MOTHERF***ER. YOU'RE DEAD."

That was weeks before Monday's ruling.

Hochul's law would have made sure more of those agents had their faces captured by those same people.

That is what "accountability" means to Kathy Hochul.

The One Thing Democrats Won

The ruling was not a complete shutout for the Left.

D'Agostino declined to block a separate New York law barring local police from entering 287(g) cooperation agreements with ICE.

Her reasoning: federal immigration enforcement has always been optional for local agencies, and choosing not to participate isn't the same as discriminating against the federal government.

Letitia James has already sent letters to a dozen New York localities ordering them to dissolve their existing ICE cooperation agreements by August 25th.

Republican sheriffs in several counties have said they won't comply.

That fight is heading to court next.

Hochul and James celebrated the 287(g) win in their joint statement while burying the loss: "As we have said from the start, New York's ban on 287(g) agreements is legal and will keep our communities safe."

What they didn't say: the centerpiece of their law – the one they held press conferences over – was just ruled unconstitutional.

Three States, Same Play, Same Result

California, Virginia, and New York didn't independently arrive at the same bad idea.

Democrats coordinated this strategy across blue states simultaneously – and federal courts in all three have now ruled the same way.

That matters beyond this one ruling.

Every injunction adds to the legal record. By the time this reaches the appeals courts, there will be a wall of precedent saying states simply do not have authority over how federal agents dress, identify themselves, or conduct federal operations.

Democrats built that wall themselves, one losing lawsuit at a time.

Hochul knew that.

She pushed the law anyway.

That tells you everything about what this was really about.
