Supreme Court allows Virginia to remove noncitizens from voting rolls
It would seem that removing noncitizens from the voting rolls is a commonsense measure all Americans can get behind.
But that’s not the reality.
The Biden-Harris Department of Justice sued the state of Virginia over Governor Glenn Youngkin’s executive order shoring up election integrity.
Part of the order included enforcing a 2006 law – which then Democrat Governor Tim Kaine signed into law – mandating the removal of noncitizens from the voting rolls.
Virginia then removed 1,600 noncitizens from the rolls.
The Biden-Harris Justice Department sprang an 11th hour lawsuit against the state of Virginia in the hopes that there wouldn’t be enough time for an appeal to work its way up to the Supreme Court.
A lower court judge blocked Virginia from keeping noncitizens off the voter rolls.
But Americans who care about election integrity could breathe a sigh of relief.
The Supreme Court stepped in and issued a stay blocking the lower court order.
Virginia could now proceed with safeguarding the integrity of the 2024 election by removing any possibility that 1,600 noncitizens could potentially vote in the election.
Governor Youngkin praised the Supreme Court’s decision as well as the work of Attorney General Jayson Miyares.
“We are pleased by the Supreme Court’s order today. This is a victory for commonsense and election fairness. I am grateful for the work of Attorney General @JasonMiyaresVA on this critical fight to protect the fundamental rights of U.S. citizens. Clean voter rolls are one important part of a comprehensive approach we are taking to ensure the fairness of our elections,” Youngkin posted on X.
“Virginians also know that we have paper ballots, counting machines not connected to the internet, a strong chain of custody process, signature verification, monitored and secured drop boxes, and a ‘triple check’ vote counting process to tabulate results. Virginians can cast their ballots on Election Day knowing that Virginia’s elections are fair, secure, and free from politically-motivated interference,” Youngkin continued.
The noncitizen voter roll loophole
It’s currently against U.S. law for noncitizens to cast a ballot in a federal election.
But some states with automatic voter registration laws add illegal aliens to the rolls when they sign up for government IDs like driver’s licenses.
That’s a loophole Republicans sought to close with the SAVE Act, which would have made it illegal for noncitizens to register to vote.
Democrats blocked that bill this fall during the government funding negotiations.
That’s when the Biden-Harris administration sued to keep noncitizens on the voting rolls in Virginia.
